Terms of Service

These Terms of Service ("Terms") govern your use of the Nanozons AI platform and services provided by Nanozons AI ("we", "our", "us"). By accessing or using Nanozons AI, you agree to be bound by these Terms.

1. Service Description

Nanozons AI is a business-to-business omnichannel conversation platform that:

• Unifies email, WhatsApp, and Telegram messaging into a single inbox
• Provides AI-assisted conversation summarization and reply drafting
• Enables cross-channel identity resolution for contacts
• Offers human-in-the-loop approval workflows for outbound messages
• Tracks message delivery across channels

2. Eligibility

Nanozons AI is designed for business use. By using our service, you represent that:

• You are at least 18 years of age
• You have the authority to bind your organization to these Terms
• Your use of the service complies with all applicable laws and regulations

3. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your workspace
• Ensuring team members comply with these Terms
• Keeping your contact and billing information accurate

4. Acceptable Use

You agree to use Nanozons AI only for lawful business communication. You must not:

• Send spam, unsolicited messages, or bulk promotional content without consent
• Transmit malicious content, malware, or phishing attempts
• Violate any applicable anti-spam or data protection laws (including CAN-SPAM, GDPR, CCPA)
• Use the platform to harass, threaten, or abuse any person
• Attempt to circumvent WhatsApp Business policies, messaging windows, or consent requirements
• Use unofficial APIs, automation tools, or personal accounts for WhatsApp messaging
• Share your account credentials with unauthorized parties
• Reverse-engineer, decompile, or attempt to extract source code from the platform
• Use the platform in any way that could damage, disable, or impair our infrastructure

5. Channel Provider Compliance

Your use of Nanozons AI is subject to the terms and policies of the underlying channel providers:

• WhatsApp: You must comply with WhatsApp Business Policy and Commerce Policy. Nanozons AI enforces the 24-hour messaging window and requires message templates for out-of-window communications.
• Email (Postmark): You must comply with applicable email regulations and maintain proper sender authentication.
• Telegram: You must comply with the Telegram Terms of Service.

Violation of channel provider policies may result in suspension of your channel connections and/or Nanozons AI account.

6. AI Features

Nanozons AI provides AI-assisted features including conversation summarization and reply drafting:

• AI-generated content is provided as suggestions only and requires human review and approval before sending
• You are responsible for reviewing and approving all outbound messages, including AI-drafted content
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content
• AI features may be updated, modified, or discontinued as we improve the platform

7. Data Ownership

• Your data: You retain ownership of all messages, contacts, and business data you process through Nanozons AI
• Our platform: We retain ownership of the Nanozons AI platform, software, and all associated intellectual property
• License to us: You grant us a limited license to process your data solely to provide and improve our service
• Data portability: You may export your data at any time

8. Pricing and Payment

• Single User: $9.99 per month (1 user)
• Teams: $16.99 per seat per month (2–10 users)
• Enterprise: $24.99 per seat per month (5+ users, unlimited)
• All plans include unlimited conversations
• We may update pricing with 30 days advance notice
• Subscriptions are billed monthly and can be cancelled at any time
• No refunds for partial months after cancellation

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for:

• Downtime of third-party channel providers (Postmark, WhatsApp/Meta, Telegram)
• Scheduled maintenance (we will provide reasonable advance notice)
• Service interruptions caused by factors beyond our reasonable control

10. Limitation of Liability

To the maximum extent permitted by law:

• Nanozons AI is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, consequential, or punitive damages
• Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
• We are not liable for the content of messages sent or received through the platform

11. Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms or any applicable channel provider policies
• Your use of the platform poses a risk to other users or our infrastructure
• We are required to do so by law or a channel provider

You may terminate your account at any time. Upon termination, we will delete your data within 30 days unless retention is required by law.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the platform at least 30 days in advance. Continued use of Nanozons AI after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
